Traditional Representation
In a traditional representation (or full-service representation) arrangement, the attorney represents one party to the case and takes on all aspects related to the legal process including drafting documents, appearing in court, and communicating with other parties. At Ardent Legal, we have experience representing clients from the beginning of their divorce and/or custody matter through to final hearing. From the first meeting with our clients, we begin building a relationship to get to know our clients to help them navigate the legal process and achieve their goals. At Ardent Legal, we pride ourselves on developing a personal relationship with each client we serve to get to know them and represent their interests to the best of our abilities.
Limited Representation
Maybe you just need some help through the legal process, but want to handle things mostly on your own. We can help with that through a limited representation arrangement. In a limited representation arrangement, the attorney only handles or helps the client with portions of the legal process. This may be a good option for someone who just wants guidance on following proper procedures, reviewing documents, or drafting documents for court, but who wants to handle the process mostly on their own. The attorney serves in limited capacity, and usually does not appear in court on behalf of the individual, unless the arrangement specifies otherwise. At Ardent Legal, we are happy to talk with you to discuss your goals to tailor a limited representation arrangement that fits your individual needs.
Mediation Services
Through mediation, an individual (called a mediator) serves as a neutral third party to help both parties to a family law action negotiate an agreement between them. Through mediation, both parties work toward a common goal of reaching an agreement, with the help of an experienced mediator. In the context of family law, the mediator can help the parties reach agreements as to property distribution, parenting, child support, alimony, and any other issues that may be involved in their individual situation. Mediators help the parties identify issues that need to be resolved, help discuss possible solutions, prioritize and focus on individual issues, and draft documents that reflect the agreements reached by the parties for submission to the Court. Although mediators cannot give legal advice, and cannot advocate for one party or the other, they can provide information to the parties about laws that impact their case. At Ardent Legal, we have experience in mediating family law disputes, and have experience helping parties reach agreements through mediation.
Morgantown, WV family law attorney, Brianna W. McCardle, has represented numerous clients through traditional representation and limited representation, and has served as a mediator for several couples going through the divorce and child custody process. Learn more about Brianna.
